Denied Workers' Comp Claims in Washington — Your Options

What to do when your Washington workers' compensation claim is denied, including dispute resolution and appeals.

Having your workers' compensation claim denied does not mean you have no options. In Washington, you have the right to challenge a denial §51.52.050.

Common Reasons for Denial

Claims are frequently denied for these reasons:

1
Late notice to employer (must be within Worker must report the accident to the employer forthwith; employer must report qualifying injuries to L&I at once (immediately)) §51.28.010; §51.28.025
2
Dispute over whether the injury is work-related
3
Pre-existing condition arguments
4
Missed medical appointments or non-compliance with treatment
5
Filing deadline expired (1 year from the day the injury occurred or the rights of dependents or beneficiaries accrued; occupational disease claims are subject to the separate deadlines in RCW 51.28.055) §51.28.050

The Dispute Resolution Process

Claims managed by L&I; protests and appeals heard by the Board of Industrial Insurance Appeals (BIIA) §51.52.050.

Appeals

Appeal to the Board of Industrial Insurance Appeals, then to Superior Court and Washington Court of Appeals.

Independent Medical Examination (IME)

L&I may require an independent medical examination; employee must cooperate or risk claim suspension. The IME results can significantly impact your claim.

⚠If the insurer requests an IME, you must attend. Failure to appear can result in suspension of benefits.
✓Before attending an IME arranged by the insurer, consult with an attorney. You have the right to have your own medical evidence reviewed and considered.
