Immigration Court Process in Washington — What to Expect
How immigration court works, NTAs, hearings, appeals, bond, and finding legal help in Washington.
Washington immigration court
Cases from Washington are heard at the Seattle Immigration Court (one of the higher-volume courts in the Pacific Northwest).
How removal proceedings work
Bond hearings
Detained individuals may request a bond hearing. The immigration judge sets bond based on flight risk and danger to the community. Minimum bond is $1,500 §8 U.S.C. 1226(a)(2)(A).
Right to counsel
You have the right to an attorney in immigration court, but the government does not provide one at public expense. Washington has invested significantly in immigration legal services. The state funds immigration legal representation through the Office of Immigrant and Refugee Affairs (OIRA) and the Universal Legal Representation Program. Northwest Immigrant Rights Project (NWIRP), Colectiva Legal del Pueblo, and numerous other organizations provide immigration legal services.
Consumer protection against fraud
Beware of "notarios" or immigration consultants who are not licensed attorneys or DOJ-accredited representatives. Washington's consumer protection law §RCW 19.86.020 may provide recourse against immigration fraud. The state also has specific anti-notario fraud protections §RCW 19.154.010.
