Filing a Workers' Comp Claim in Ohio — Steps & Deadlines

How to report a workplace injury, file a workers' compensation claim, and meet deadlines in Ohio.

Filing a workers' compensation claim in Ohio involves specific steps and deadlines that must be followed carefully §4123.01.

Step 1: Report the Injury

You must report your workplace injury to your employer within. Written notice is always recommended even if verbal notice is given.

⚠Failure to give timely notice can be used by the employer or insurer as grounds to deny your claim.

Step 2: Get Medical Treatment

Injured workers generally may choose a treating provider, but whether treatment is paid for often depends on the provider's BWC certification and on the program covering the claim (state-fund, qualified health plan, or self-insuring employer); confirm the rules for your claim with a lawyer or your managed care organization.. Make sure to:

1
Tell the doctor your injury is work-related
2
Follow the treatment plan completely
3
Keep copies of all medical records and bills
4
Report any work restrictions to your employer

Step 3: File the Formal Claim

You have 1 year from date of injury or death to file a formal claim §4123.84. Claim filed with BWC; contested claims heard by the Industrial Commission of Ohio through a district hearing officer §4123.511.

Step 4: Investigation and Response

After filing, the employer's insurer will investigate the claim. They may accept, partially accept, or deny the claim. If denied, you have the right to request a hearing.

What Happens at a Hearing?

Claim filed with BWC; contested claims heard by the Industrial Commission of Ohio through a district hearing officer §4123.511. Appeal to a staff hearing officer of the Industrial Commission, then to the Industrial Commission, then to Ohio court of common pleas.
