Iowa DUI Refusal — Penalties & Consequences

How a refusal can affect evidence, licensing issues, and case strategy.

Refusing a chemical test during a OWI stop in Iowa has consequences on both the administrative and criminal tracks. Understanding what a refusal triggers — and what it does not prevent — is critical to evaluating your situation.

What Iowa's implied consent law requires

By driving on Iowa roads, you have implicitly consented to chemical testing (breath, blood, or urine) when an officer has lawful grounds to arrest you for OWI. This does not mean you cannot refuse — it means refusal itself carries legal consequences.

Administrative consequences of refusal

A first refusal in Iowa results in: 1-year license revocation.

This administrative suspension is separate from criminal penalties. The Implied consent law provides an incentive to submit to testing, and refusal carries its own distinct consequences.

Can refusal be used against you in court?

In Iowa, your refusal can be used as evidence against you at trial.

How refusal affects the criminal case

Refusing the test does not end the criminal case. The prosecution can still pursue OWI charges based on:

  • Officer observations (driving pattern, physical symptoms, statements)
  • Field sobriety test results
  • Any other available evidence (dashcam video, witness testimony)
  • In some jurisdictions, a warrant-obtained blood draw despite the refusal
💡A refusal eliminates one type of evidence (the BAC number) but does not eliminate the case. It changes the evidentiary landscape for both sides.

The dual-track impact of refusal

Refusal makes the administrative track worse (longer suspension, fewer options for restricted driving) while making the criminal track different — not necessarily better or worse. The prosecution loses a specific number but may gain a jury inference from the refusal itself.

Refusal vs. test failure: side-by-side

FactorTest FailureTest Refusal

Can be used in courtYes — BAC result is direct evidenceYes — refusal itself may be used as evidence
IID requirementrequired for the entire period the Temporary Restricted License is issued, plus any additional post-reinstatement period under § 321J.17(3) — one year from reinstatement for a second or subsequent revocation (or a § 321J.21 conviction), reduced by valid TRL time and extendable under the compliance-based removal procedures §321J.20; §321J.17May be longer; check with an attorney

Requesting the administrative hearing after refusal

The hearing deadline is the same as for test failures: 10 days after receipt of notice of revocation (hearing request form under Iowa Code § 321J.13). At the hearing, the issues may include whether the officer had probable cause, whether the implied consent advisement was properly given, and whether the refusal was knowing and voluntary.

⚠Do not assume that refusing the test will make the case go away. In most cases, it makes the license consequences worse while leaving the criminal case intact. The decision to refuse has already been made — focus on the administrative hearing deadline and building the best defense with the facts as they are.
