Iowa DUI & License Suspension — What Happens
Administrative license issues and why timing matters.
How the administrative suspension works
Suspension periods
- First-offense (failed test): 180 days (failed test, no prior revocation); 1 year (refusal, no prior revocation)
- First-offense (refusal): 1-year license revocation
Restricted driving privileges
Iowa does offer a form of restricted or limited driving privileges during or after the administrative suspension. Temporary Restricted License (TRL) available with IID installation, SR-22 insurance, and $200 civil penalty.
How the administrative and criminal tracks interact
The administrative suspension and the criminal case are legally independent. Winning the administrative hearing does not dismiss the criminal case. Losing the administrative hearing does not prove guilt in the criminal case. However, the facts overlap significantly, and the administrative hearing can sometimes reveal evidence or testimony that is useful in the criminal defense.
Ignition interlock and license reinstatement §321J.20; §321J.17
mandatory before a Temporary Restricted License is issued — the device must be installed on all motor vehicles the applicant operates (narrow exception: a person revoked under § 321J.21 may apply without a device once 12 years have elapsed since the end of the underlying revocation period). The minimum IID period is required for the entire period the Temporary Restricted License is issued, plus any additional post-reinstatement period under § 321J.17(3) — one year from reinstatement for a second or subsequent revocation (or a § 321J.21 conviction), reduced by valid TRL time and extendable under the compliance-based removal procedures. Reinstatement requires proof of IID installation, completion of any required substance abuse programs, payment of reinstatement fees, and proof of insurance (SR-22 in many states).
