Immigration Court Process in Virginia — What to Expect
How immigration court works, NTAs, hearings, appeals, bond, and finding legal help in Virginia.
Virginia immigration court
Cases from Virginia are heard at the Arlington Immigration Court (one of the busiest courts in the nation, handling cases from Virginia, Maryland, and surrounding areas).
How removal proceedings work
Bond hearings
Detained individuals may request a bond hearing. The immigration judge sets bond based on flight risk and danger to the community. Minimum bond is $1,500 §8 U.S.C. 1226(a)(2)(A).
Right to counsel
You have the right to an attorney in immigration court, but the government does not provide one at public expense. Virginia does not have a dedicated state-funded immigration legal aid program. Nonprofit organizations including the Legal Aid Justice Center, Ayuda, the Capital Area Immigrants' Rights (CAIR) Coalition, and the Virginia Poverty Law Center provide immigration legal services. Northern Virginia has a relatively robust network of immigration attorneys and nonprofit providers due to proximity to Washington, D.C.
Consumer protection against fraud
Beware of "notarios" or immigration consultants who are not licensed attorneys or DOJ-accredited representatives. Virginia's consumer protection law §59.1-200 may provide recourse against immigration fraud. The state also has specific anti-notario fraud protections §47.1-15.1.
