Vermont DUI & License Suspension — What Happens
Administrative license issues and why timing matters.
How the administrative suspension works
Suspension periods
- First-offense (failed test): 90-day suspension (failed test); 6 months (refusal)
- First-offense (refusal): 6-month license suspension (civil); criminal refusal charge possible
Restricted driving privileges
Vermont does not offer a restricted or hardship license during the administrative suspension period. Vermont does not offer a restricted/hardship license during administrative suspension for first offenses
How the administrative and criminal tracks interact
The administrative suspension and the criminal case are legally independent. Winning the administrative hearing does not dismiss the criminal case. Losing the administrative hearing does not prove guilt in the criminal case. However, the facts overlap significantly, and the administrative hearing can sometimes reveal evidence or testimony that is useful in the criminal defense.
Ignition interlock and license reinstatement §23-1213
Not automatically required in every case — a driver suspended for DUI may apply for an ignition interlock RDL or certificate to drive during the suspension. Whether interlock becomes a condition of your reinstatement, and for how long, depends on your case — confirm with a lawyer.. The minimum IID period is waiting and interlock periods are set by statute and vary by offense and circumstances — confirm the current period with a lawyer. Reinstatement requires proof of IID installation, completion of any required substance abuse programs, payment of reinstatement fees, and proof of insurance (SR-22 in many states).
