South Dakota Move-Out Damages & Deposit Disputes

How damage claims and move-out disputes are usually analyzed.

Move-out disputes typically center on what the landlord deducts from the Security deposit and whether those deductions are legitimate under South Dakota law §43-32-6.1; §43-32-24.

Normal wear and tear vs. damage

The key distinction in almost every deposit dispute:

  • Normal wear and tear: Minor scuffs on walls, carpet wear in high-traffic areas, small nail holes, fading from sunlight, minor door or cabinet wear. These cannot be deducted.
  • Damage beyond normal wear: Large holes in walls, stained or burned carpets, broken fixtures, missing appliances, pet damage, unauthorized modifications. These can be deducted.

The move-out process

1
Give proper notice
For month-to-month tenancies, provide 30 days' written notice.
2
Clean thoroughly
Remove all belongings and clean the unit. The condition at move-out will be compared to the condition at move-in.
3
Do a walk-through
Request a joint walk-through with the landlord if possible. Note any pre-existing damage that was present at move-in.
4
Document everything
Take dated photos and videos of every room, including closets, appliances, and fixtures. This is your most important evidence.
5
Return all keys
The deposit return clock starts when you vacate and return keys/access devices.

After move-out

The landlord has 21 days to return the deposit or provide an itemized statement of deductions §43-32-6.1; §43-32-24.

The itemization must list each deduction with a specific reason and amount.

Disputing deductions

If you believe deductions are unfair:

  • Compare the deduction list to your move-in and move-out documentation
  • Send a written demand letter to the landlord explaining which deductions you dispute and why
  • If the landlord does not respond or refuses to refund, you can file a claim in small claims court
  • Penalty for wrongful withholding: lessor who fails to comply forfeits all rights to withhold any portion of the deposit; bad-faith retention or bad-faith failure to provide the written statement or itemized accounting subjects the lessor to punitive damages up to $200
✓The single most effective thing you can do is create a thorough photographic record at both move-in and move-out. Without this evidence, deposit disputes often come down to credibility.
