Immigration Court Process in Pennsylvania — What to Expect
How immigration court works, NTAs, hearings, appeals, bond, and finding legal help in Pennsylvania.
Pennsylvania immigration court
Cases from Pennsylvania are heard at the Philadelphia Immigration Court; York Immigration Court; Pittsburgh Immigration Court.
How removal proceedings work
Bond hearings
Detained individuals may request a bond hearing. The immigration judge sets bond based on flight risk and danger to the community. Minimum bond is $1,500 §8 U.S.C. 1226(a)(2)(A).
Right to counsel
You have the right to an attorney in immigration court, but the government does not provide one at public expense. Pennsylvania does not have a dedicated state-funded immigration legal aid program. Philadelphia-based organizations including HIAS Pennsylvania, Nationalities Service Center, and Pennsylvania Immigrant and Citizen Action provide immigration legal services. Regional Legal Services and MidPenn Legal Services provide limited services in other parts of the state.
Consumer protection against fraud
Beware of "notarios" or immigration consultants who are not licensed attorneys or DOJ-accredited representatives. Pennsylvania's consumer protection law §73 P.S. 201-3 may provide recourse against immigration fraud. The state also has specific anti-notario fraud protections §18 Pa. C.S. 4912.
