Immigration Court Process in Oregon — What to Expect
How immigration court works, NTAs, hearings, appeals, bond, and finding legal help in Oregon.
Oregon immigration court
Cases from Oregon are heard at the Portland Immigration Court.
How removal proceedings work
Bond hearings
Detained individuals may request a bond hearing. The immigration judge sets bond based on flight risk and danger to the community. Minimum bond is $1,500 §8 U.S.C. 1226(a)(2)(A).
Right to counsel
You have the right to an attorney in immigration court, but the government does not provide one at public expense. Oregon has invested in immigration legal services. The Oregon Legislature has funded the Immigration Services Program through the Department of Justice to provide legal representation and education for immigrants. Immigrant Law Group, NWIRP Oregon offices, and Legal Aid Services of Oregon provide additional services.
Consumer protection against fraud
Beware of "notarios" or immigration consultants who are not licensed attorneys or DOJ-accredited representatives. Oregon's consumer protection law §ORS 646.608 may provide recourse against immigration fraud. The state also has specific anti-notario fraud protections §ORS 9.280.
