How immigration court works, NTAs, hearings, appeals, bond, and finding legal help in North Carolina.
North Carolina immigration court
Cases from North Carolina are heard at the Charlotte Immigration Court.
How removal proceedings work
Bond hearings
Detained individuals may request a bond hearing. The immigration judge sets bond based on flight risk and danger to the community. Minimum bond is $1,500 §8 U.S.C. 1226(a)(2)(A).
Right to counsel
You have the right to an attorney in immigration court, but the government does not provide one at public expense. North Carolina does not have a dedicated state-funded immigration legal aid program. Legal Aid of North Carolina operates the Immigration Pathways for Victims program for survivors of domestic violence and trafficking, relying on federal and private funding. Nonprofit organizations in Charlotte, Raleigh, and Durham provide limited services.
Consumer protection against fraud
Beware of "notarios" or immigration consultants who are not licensed attorneys or DOJ-accredited representatives. North Carolina's consumer protection law §75-1.1 may provide recourse against immigration fraud. The state also has specific anti-notario fraud protections §10B-20; §84-4.
