After a DUI Arrest in New Mexico — Next Steps
Timing issues.
Immediate priorities after arrest
The administrative track starts immediately
The administrative suspension for a first offense in New Mexico is 6 months (failed test, driver 21 or older); 1 year (refusal, driver under 21, or prior revocation under this section) — in each case until all license reinstatement conditions are met, whichever is later §66-8-112; §66-8-111. Ignition Interlock License allows driving anywhere in New Mexico during revocation if IID is installed.
The criminal track timeline
The criminal case proceeds on a slower timeline. The first court appearance (Arraignment) is set weeks after the arrest. At arraignment, you enter a plea, the court addresses bond conditions, and future dates are set.
Common mistakes in the first 48 hours
- Missing the administrative hearing deadline (10 days after receipt of the notice of revocation (written request accompanied by $25 or a sworn statement of indigency))
- Discussing the case on social media or with anyone other than an attorney
- Assuming the case will "go away" because you feel you were not impaired
- Ignoring bond conditions (such as no-alcohol provisions or random testing)
- Waiting for the court date before seeking legal advice
