Nebraska Workers' Compensation Guide — Benefits, Claims & Rights
Workers' compensation coverage, benefits, filing deadlines, and dispute resolution in Nebraska.
Workers' compensation is a no-fault system — you do not have to prove your employer was negligent to receive benefits. But the process still requires specific steps in a specific order: reporting the injury, filing a formal claim, and getting treatment through authorized providers. If the insurer disputes your claim, the process shifts to hearings and appeals. Acting quickly matters, because most states impose strict deadlines for reporting and filing.
Who Is Covered?
Nebraska requires workers' compensation insurance for the state and its agencies, and resident employers and nonresident employers performing work in nebraska with one or more employees in the employer's regular trade, business, profession, or vocation, except employments the act excludes (interstate or foreign-commerce railroads; household domestic servants in a private residence; agricultural operations employing only related employees; agricultural operations with unrelated employees unless 10 or more unrelated full-time employees are employed on each working day for 13 calendar weeks in a calendar year; and occasional reciprocal service between agricultural operators); exempt employers may elect coverage by obtaining a workers' compensation insurance policy §48-106. The Exclusive remedy doctrine means that in most cases, workers' comp is your sole remedy against your employer for workplace injuries §48-148.
