| Effect | Loan continues as if no default | Property returned to borrower; sale reversed |
Reinstatement
Montana allows reinstatement — paying all past-due amounts, fees, and costs to bring the loan current and stop the foreclosure. The deadline to reinstate is before the trustee sale — where a trust indenture obligation has been accelerated before maturity, the borrower (or a successor in interest or junior lienholder) may reinstate by paying the entire amount then due, plus costs and reasonable trustee's and attorney fees (excluding principal not yet due absent default), at any time prior to the time fixed for the trustee's sale §71-1-312.
No post-sale redemption
Montana does not provide a statutory right of redemption after the foreclosure sale. Once the sale is confirmed and the deed is transferred, the borrower's ownership interest is extinguished.
