Mississippi Rental Repairs & Habitability Rights
Common disputes.
What must be maintained
The landlord is required to maintain essential services, including:
- Running water
- Hot water
- Heat
- Electricity
- Sanitation
How to request repairs
1
Put your request in writing
Send written notice to the landlord describing the problem. Keep a copy. Email or certified mail creates a paper trail.
2
3
Document the condition
Take dated photos and videos. Note how the condition affects your daily living. Save all communications with the landlord.
4
Know your remedies if repairs are not made
You may be able to repair the issue yourself and deduct the cost from rent §89-8-15, subject to specific conditions and limits. Rent withholding is not available in this state.
⚠Never withhold rent without first giving the landlord written notice and the required time to repair. Withholding rent improperly can result in eviction for nonpayment. If you are considering this remedy, consult an attorney first.
Constructive eviction
Mississippi recognizes Constructive eviction — if conditions become so bad that the property is effectively uninhabitable, the tenant may be able to terminate the lease and move out without further rent obligation. This defense requires that the tenant actually vacate the property.
✓The strongest habitability claims are supported by written notice to the landlord, documented conditions (photos, videos), and evidence that the landlord had reasonable time to repair but did not.
