What a advance health-care directive covers §18-C-5-803
A advance health-care directive addresses:
- Life-sustaining treatment (ventilators, dialysis)
- Artificial nutrition and hydration (feeding tubes)
- Resuscitation preferences (DNR orders)
- Pain management and comfort care
- Organ and tissue donation
Choosing a health-care agent §18-C-5-803
Your health-care agent should be someone who:
- Understands your values and treatment preferences
- Can make difficult decisions under pressure
- Is willing and able to advocate for your wishes, even against family pressure
- Lives nearby or can be reached quickly in an emergency
Name a successor agent in case your first choice is unavailable.
Maine law
Maine adopted the Uniform Health-Care Decisions Act (18-C M.R.S. § 5-801 et seq.). An individual instruction may be oral or written (an oral instruction is valid only if made to a health care provider or a person who may serve as surrogate), but a power of attorney for health care must be in writing and signed by the principal and 2 witnesses, whose signatures must be made in person and not by electronic means. A directive that is valid under the laws of the state where it was executed is valid in Maine. Maine provides a statutory form.
