Maine DUI & License Suspension — What Happens
Administrative license issues and why timing matters.
How the administrative suspension works
Suspension periods
- First-offense (failed test): a period set by statute (failed test or refusal); confirm the current length with a lawyer
- First-offense (refusal): 275-day license suspension
Restricted driving privileges
Maine does not offer a restricted or hardship license during the administrative suspension period. Maine does not offer a restricted or hardship license during OUI administrative suspension periods. Reinstatement requires completion of the full suspension and payment of fees.
How the administrative and criminal tracks interact
The administrative suspension and the criminal case are legally independent. Winning the administrative hearing does not dismiss the criminal case. Losing the administrative hearing does not prove guilt in the criminal case. However, the facts overlap significantly, and the administrative hearing can sometimes reveal evidence or testimony that is useful in the criminal defense.
Ignition interlock and license reinstatement §29-A-2508
Secretary of State may reinstate the license after 30 days of the suspension period has been served if an approved ignition interlock device is installed. The minimum IID period is for the length of time remaining on the suspension (first offense: remainder after 30 days served). Reinstatement requires proof of IID installation, completion of any required substance abuse programs, payment of reinstatement fees, and proof of insurance (SR-22 in many states).
