Immigration Court Process in Kentucky — What to Expect
How immigration court works, NTAs, hearings, appeals, bond, and finding legal help in Kentucky.
Kentucky immigration court
Cases from Kentucky are heard at the Louisville Immigration Court; Lexington-area cases may be heard in Louisville or Cincinnati, OH via video teleconference.
How removal proceedings work
Bond hearings
Detained individuals may request a bond hearing. The immigration judge sets bond based on flight risk and danger to the community. Minimum bond is $1,500 §8 U.S.C. 1226(a)(2)(A).
Right to counsel
You have the right to an attorney in immigration court, but the government does not provide one at public expense. Kentucky does not provide state-funded immigration legal aid. Legal Aid Network of Kentucky provides limited immigration services through federal and private funding. Catholic Charities of Louisville Refugee and Immigration Services and other nonprofit organizations offer additional limited assistance.
Consumer protection against fraud
Beware of "notarios" or immigration consultants who are not licensed attorneys or DOJ-accredited representatives. Kentucky's consumer protection law §KRS 367.170 may provide recourse against immigration fraud.
