Denied Workers' Comp Claims in Idaho — Your Options

What to do when your Idaho workers' compensation claim is denied, including dispute resolution and appeals.

Having your workers' compensation claim denied does not mean you have no options. In Idaho, you have the right to challenge a denial §72-706.

Common Reasons for Denial

Claims are frequently denied for these reasons:

1
Late notice to employer (must be within 60 days from date of accident or manifestation of occupational disease) §72-701
2
Dispute over whether the injury is work-related
3
Pre-existing condition arguments
4
Missed medical appointments or non-compliance with treatment
5
Filing deadline expired (1 year from date of making claim if no compensation was paid; 5 years from date of accident (or first manifestation of occupational disease) if compensation was paid and discontinued; 1 year from last payment of income benefits if discontinued more than 4 years after the accident) §72-706

The Dispute Resolution Process

Complaint filed with the Idaho Industrial Commission; hearing before a referee (hearing officer) §72-706.

Appeals

Review by the full Industrial Commission, then appeal to Idaho Supreme Court.

Independent Medical Examination (IME)

Employer or Commission may require employee to submit to an independent medical examination §72-433. The IME results can significantly impact your claim.

⚠If the insurer requests an IME, you must attend. Failure to appear can result in suspension of benefits.
✓Before attending an IME arranged by the insurer, consult with an attorney. You have the right to have your own medical evidence reviewed and considered.
