Idaho Guardianship for Minor Children — How to File
Nominating a guardian for your children — what happens if you don't, and how to plan ahead.
Guardianship for minor children §15-5-201
Your will is the primary way to nominate a guardian for your minor children. Without a nomination, the court decides — and the process can be contentious if family members disagree.
How guardian nomination works
Guardianship for incapacitated adults §15-5-301
When an adult can no longer manage their own affairs and has no Power of attorney or other advance planning in place, a family member or interested party can petition the court for guardian and conservator §15-5-301.
Why guardianship is a last resort
- It requires a court proceeding with legal fees and ongoing reporting
- The incapacitated person loses legal rights — the court, not the family, decides who serves
- The guardian must file periodic reports and accountings with the court
- It is public — anyone can access guardianship records
A Power of attorney and durable power of attorney for health care §39-4510, created while you have capacity, avoid the need for guardianship entirely. These documents let you choose your own agent privately and without court involvement.
Guardian vs. conservator
| Guardian of the person | Conservator / guardian of the estate | |
|---|---|---|
| Scope | Personal decisions — housing, medical care, daily needs §15-5-301 | Financial decisions — assets, bills, investments |
| Who needs it | Someone who cannot make personal decisions | Someone who cannot manage finances |
| Court oversight | Periodic reports on the person's well-being | Financial accountings filed with the court |
| Can be same person | Yes — the court may appoint one person for both roles | Yes, but splitting responsibilities is sometimes better |
Idaho follows the UPC model for guardianship and conservatorship. Community property state.
