Idaho DUI & License Suspension — What Happens
Administrative license issues and why timing matters.
How the administrative suspension works
Suspension periods
- First-offense (failed test): 90 days (30 days absolute, then restricted permit available for test failures); 1 year absolute for refusals
- First-offense (refusal): 1-year absolute license suspension (no restricted license); $250 civil fine; 1-year IID required after suspension ends
Restricted driving privileges
Idaho does offer a form of restricted or limited driving privileges during or after the administrative suspension. Available for test failures after 30-day absolute suspension — not available for refusals.
How the administrative and criminal tracks interact
The administrative suspension and the criminal case are legally independent. Winning the administrative hearing does not dismiss the criminal case. Losing the administrative hearing does not prove guilt in the criminal case. However, the facts overlap significantly, and the administrative hearing can sometimes reveal evidence or testimony that is useful in the criminal defense.
Ignition interlock and license reinstatement §18-8008
mandatory when any or all of a sentence or fine is suspended for a DUI offense; court orders installation on all vehicles operated, at offender's expense. The minimum IID period is 1 year from the date the ignition interlock vendor provides proof of installation (§ 18-8008(5), as amended 2026). Reinstatement requires proof of IID installation, completion of any required substance abuse programs, payment of reinstatement fees, and proof of insurance (SR-22 in many states).
