Hawaii Eviction Notice — Deadlines & Responses

Notice types, timelines, and what to document.

Eviction in Hawaii begins with a written notice. The type of notice, the required waiting period, and whether you can fix the problem all depend on the reason for eviction §521:1 et seq..

Nonpayment of rent

1
Landlord serves written notice
The landlord must provide 10 calendar days (a copy of the notice must also go to a state-funded mediation center; if mediation is scheduled within the 10 calendar days and the tenant participates, the landlord may file for summary possession only after 20 calendar days from the tenant's receipt of the notice, unless the tenant fails to appear or cancels) days' written notice before filing for eviction §521:68.
2
Tenant pays within cure period
You have 10 calendar days days to pay the full amount owed. If you pay in full within this period, the eviction cannot proceed.
3
Landlord files court action
If rent is not paid within the notice period, the landlord can file a summary possession action. The hearing is typically set 14–21 days after filing.

Lease violations

For lease violations other than nonpayment, the landlord must provide 10 days' written notice §521:69. The tenant has 10 days to cure (fix) the violation.

Unconditional quit

In some situations (such as repeated violations or illegal activity), the landlord can issue an unconditional quit notice giving 10 days to vacate with no opportunity to cure.

Month-to-month termination

For month-to-month tenancies, either party can terminate with 28 days' written notice.

What makes a notice valid

  • Must be in writing
  • Must specify the reason for eviction
  • Must give the correct number of days
  • Must be properly served (methods vary — personal delivery, posting on door, mail)
⚠An Eviction notice that does not meet these requirements may be invalid. If you receive a notice that appears defective, this is a potential defense — but do not ignore the notice. Respond within the stated deadline while raising the defect.

What to do when you receive a notice

✓Read the notice carefully and note the deadline. Gather evidence (lease, rent receipts, photos, communications). If you believe the notice is improper or you have a defense, consult an attorney before the deadline expires.
