Immigration Court Process in Hawaii — What to Expect
How immigration court works, NTAs, hearings, appeals, bond, and finding legal help in Hawaii.
Hawaii immigration court
Cases from Hawaii are heard at the Honolulu Immigration Court.
How removal proceedings work
Bond hearings
Detained individuals may request a bond hearing. The immigration judge sets bond based on flight risk and danger to the community. Minimum bond is $1,500 §8 U.S.C. 1226(a)(2)(A).
Right to counsel
You have the right to an attorney in immigration court, but the government does not provide one at public expense. Hawaii does not have a dedicated state-funded immigration legal aid program. Legal Aid Society of Hawaii provides limited immigration services. The Hawaii Immigrant Justice Center (at UH Richardson School of Law) and immigrant advocacy organizations provide additional resources.
Consumer protection against fraud
Beware of "notarios" or immigration consultants who are not licensed attorneys or DOJ-accredited representatives. Hawaii's consumer protection law §HRS 480-2 may provide recourse against immigration fraud. The state also has specific anti-notario fraud protections §HRS 605-14.
