Hawaii DUI & License Suspension — What Happens
Administrative license issues and why timing matters.
How the administrative suspension works
Suspension periods
- First-offense (failed test): 1 year (failed test); 2 years (refusal) for a first offense; longer periods apply with prior enforcement contacts or aggravating factors — confirm with a lawyer.
- First-offense (refusal): 2-year license revocation (no prior enforcement contacts)
Restricted driving privileges
Hawaii does offer a form of restricted or limited driving privileges during or after the administrative suspension. Ignition interlock permit available after 30-day hard suspension on first offense; requires IID installation.
How the administrative and criminal tracks interact
The administrative suspension and the criminal case are legally independent. Winning the administrative hearing does not dismiss the criminal case. Losing the administrative hearing does not prove guilt in the criminal case. However, the facts overlap significantly, and the administrative hearing can sometimes reveal evidence or testimony that is useful in the criminal defense.
Ignition interlock and license reinstatement §291E-41
required for ignition interlock permit during 1-year revocation period. The minimum IID period is 1 year for first offense. Reinstatement requires proof of IID installation, completion of any required substance abuse programs, payment of reinstatement fees, and proof of insurance (SR-22 in many states).
