Colorado Small Estate Alternatives to Probate

Simplified probate procedures for smaller estates in Colorado — summary distribution, affidavits, and when full probate is still required.

Not every estate requires full Probate administration. Colorado provides simplified procedures for smaller estates that meet certain criteria §15-12-1201.

Colorado's small estate option

RequirementDetails
Procedure namecollection by affidavit §15-12-1201
Estate value thresholdMust be under $86,000 (personal property only; amount adjusted annually for CPI per C.R.S. 15-10-112) §15-12-1201
Additional requirementsAffidavit available 10 days after death for personal property only. Does not apply to real property. §15-12-1201

Colorado allows collection by affidavit for qualifying estates. The threshold is $86,000 (personal property only; amount adjusted annually for CPI per C.R.S. 15-10-112). Affidavit available 10 days after death for personal property only. Does not apply to real property.

When full probate is still required

Even a small estate may need full administration if:

  • There is real property titled solely in the decedent's name (in states where the simplified process covers personal property only)
  • There is a dispute among heirs about who inherits
  • There are contested Creditor claims
  • The value exceeds the small-estate threshold once all assets are properly valued

How the simplified process works

  • An heir or person entitled to the property prepares an affidavit (sworn statement) attesting to their right to receive the assets
  • The affidavit is presented to whoever holds the property (bank, employer, insurance company, etc.)
  • The holder is authorized to release the property based on the affidavit
  • No court appointment of a Personal representative is needed
✓Even when a small estate procedure is available, consulting an attorney can help confirm eligibility and avoid complications — especially when there are debts, disputes, or uncertainty about asset values.
