Colorado DUI & License Suspension — What Happens
Administrative license issues and why timing matters.
How the administrative suspension works
Suspension periods
- First-offense (failed test): 9 months (BAC 0.08-0.149%); revocation effective 7 days after notice unless hearing requested
- First-offense (refusal): 1-year license revocation; also designates driver as Persistent Drunk Driver with 2-year IID requirement upon reinstatement
Restricted driving privileges
Colorado does offer a form of restricted or limited driving privileges during or after the administrative suspension. After 1 month of revocation, the driver may obtain early reinstatement with an ignition interlock restricted license for the remaining 8 months.
How the administrative and criminal tracks interact
The administrative suspension and the criminal case are legally independent. Winning the administrative hearing does not dismiss the criminal case. Losing the administrative hearing does not prove guilt in the criminal case. However, the facts overlap significantly, and the administrative hearing can sometimes reveal evidence or testimony that is useful in the criminal defense.
Ignition interlock and license reinstatement §42-2-132.5
available/required for early reinstatement after admin revocation; mandatory for Persistent Drunk Drivers (BAC ≥ 0.15 or refusal) and all repeat offenders. The minimum IID period is first offense (standard BAC): early reinstatement with IID available at any time, with the restriction lasting the time remaining on the 9-month revocation and removal possible after 4 consecutive clean monthly interlock reports; 2 years for Persistent Drunk Drivers or refusals; 2-5 years for multiple convictions. Reinstatement requires proof of IID installation, completion of any required substance abuse programs, payment of reinstatement fees, and proof of insurance (SR-22 in many states).
